These Terms of Service (“Terms”) govern your access to and use of the Accounter26 platform, including our website, AI accounting agent, and related services (collectively, the “Service”), operated by Accounter26 (Pty) Ltd, a company registered in the Republic of South Africa with its principal office in Cape Town (“Company,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
Accounter26 provides an AI-powered accounting agent that automates bookkeeping tasks for startups and small businesses. The Service includes transaction categorisation, bank feed reconciliation, anomaly detection, and month-end preparation. The Service is designed to assist with — not replace — professional accounting advice.
The Service does not constitute financial, tax, or legal advice. You remain solely responsible for the accuracy of your financial records and compliance with applicable laws, including the South African Income Tax Act, Companies Act, and any other relevant legislation.
You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Service. The Service is intended for business use; consumer accounts are not supported at this time.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at security@accounter26.com if you suspect any unauthorised access.
The Service connects to third-party financial platforms (including bank feeds, Stripe, payroll providers, and accounting software) via secure APIs. By authorising these connections, you grant us permission to access, retrieve, and process the financial data necessary to deliver the Service.
We do not store your banking credentials. All third-party connections are managed through industry-standard aggregation partners that comply with applicable data protection regulations.
The Service uses artificial intelligence to categorise transactions, detect anomalies, and generate financial summaries. While we strive for accuracy, AI-generated outputs may contain errors. You acknowledge that:
Pricing is published on our website and may change with 30 days’ written notice. All fees are quoted in South African Rand (ZAR) unless otherwise stated and are exclusive of VAT, which will be added where applicable at the prevailing rate.
During the early-access period, certain features may be offered at no charge. We reserve the right to introduce or modify pricing as the Service matures. Early-access users will receive at least 60 days’ notice before any paid plan takes effect.
You agree not to:
All rights, title, and interest in the Service — including its software, AI models, designs, and documentation — are and remain the exclusive property of Accounter26 (Pty) Ltd. Your use of the Service does not grant you any ownership rights in the platform or its underlying technology.
You retain all rights to your financial data. We claim no ownership over the data you upload or the outputs generated from your data.
To the maximum extent permitted by South African law, Accounter26 (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claim arising from or related to the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
Either party may terminate this agreement at any time by providing written notice. Upon termination, your right to access the Service will cease immediately. We will make your data available for export for a period of 30 days following termination, after which it may be permanently deleted.
We reserve the right to suspend or terminate your account immediately if we reasonably believe you have violated these Terms or engaged in conduct that could harm the Service or other users.
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape Division, Cape Town.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, notify you via email or an in-app notification. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
